- Automated appointment booking via calendar integration
- SMS and email appointment reminders
- Client lookup and CRM logging
- Post-call summaries and usage reporting
- Multi-vertical AI agent configuration (dental, fitness, trades, medical, and more)
2. Important Disclaimers
It does not guarantee specific business outcomes, booking volumes, revenue, or client retention. Results depend on your business, market, and the quality of information provided to configure your AI agent.
2.1 No Guarantee of Results
Use of this Platform does NOT guarantee:
- Any specific number of calls answered, bookings made, or clients retained
- Revenue growth or return on investment
- That all inbound calls will be handled perfectly by the AI
- 100% delivery of SMS or email reminders (delivery depends on third-party carriers)
- That the AI agent will replace the need for human staff in all situations
2.2 No Professional Advice
Nothing on this Platform constitutes:
- Legal advice regarding telecommunications or data protection compliance
- Medical, dental, fitness, or professional advice of any kind
- Financial or business strategy advice
- A guarantee of compliance with any applicable laws or regulations
2.3 AI Voice Agent Limitations
The AI voice agent technology used in this Platform:
- May occasionally misunderstand caller requests or provide inaccurate responses
- May not handle all conversation scenarios perfectly, especially highly complex or emotional situations
- Should not be relied upon as the sole method of client communication for urgent or safety-related matters
- Does not replace professional human judgment in business or clinical decisions
- May have reduced accuracy with strong accents, background noise, or poor call quality
2.4 Communication Delivery
We rely on Telnyx (SMS/phone) and Hostinger SMTP (email) for message delivery. We cannot guarantee:
- 100% delivery of SMS reminders (affected by carrier policies and filters)
- 100% delivery of email reminders (affected by spam filters and inbox providers)
- Specific timing of message delivery
- That all calls will connect successfully
2.5 Your Configuration Responsibility
You are solely responsible for:
- Providing accurate business information used by the AI agent (services, hours, pricing, policies)
- Keeping your connected calendar availability up to date
- Ensuring your AI agent configuration complies with applicable laws in your industry and jurisdiction
- Informing callers that their call may be recorded where required by law
- Reviewing and approving your AI agent’s behaviour before going live
3. Limitation of Liability
3.1 General Limitation
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DIGITAL AUTOMATIONS AI AND ITS OWNERS, OPERATORS, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:
a) Any direct, indirect, incidental, special, consequential, or punitive damages arising from:
- Use or inability to use the Platform
- Missed calls or failed bookings
- AI agent errors, misunderstandings, or unexpected conversation outcomes
- Failed SMS, email, or voice call delivery
- Client data loss or corruption
- Actions or inactions of your clients or callers
- Regulatory penalties arising from your use of the Service
- System outages, errors, or technical failures
- Third-party service failures (Retell AI, Telnyx, etc.)
b) Any claims arising from:
- Business information you provided to configure the AI agent
- Appointments booked or cancelled through the Service
- Interactions between your AI agent and your callers
- Business decisions made based on Platform data or reports
3.2 Maximum Liability Cap
IN NO EVENT SHALL THE TOTAL LIABILITY OF DIGITAL AUTOMATIONS AI EXCEED THE GREATER OF:
- THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR
- ONE HUNDRED DOLLARS ($100)
3.3 Essential Purpose
THESE LIMITATIONS APPLY EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE, REGARDLESS OF THE THEORY OF LIABILITY, AND TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
4. Indemnification
Subscribers agree to indemnify, defend, and hold harmless Digital Automations AI and its officers, directors, employees, contractors, and agents from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from:
- Inaccurate or misleading business information provided to configure the AI agent
- Privacy law violations related to client data collection and call recording
- Telecommunications law violations in your jurisdiction
- Claims from callers or clients regarding your AI agent’s conduct
- Your violation of these Terms or any applicable law
5. Subscriber Acknowledgments
By using this Platform, you acknowledge and agree that:
- RESULTS NOT GUARANTEED: The AI agent is a tool. Business outcomes depend on your configuration, industry, market, and client base. No specific results are promised.
- AI LIMITATIONS: The AI agent may occasionally make errors or mishandle complex conversations. You will monitor agent performance and notify Digital Automations of issues.
- COMPLIANCE RESPONSIBILITY: You are solely responsible for ensuring your use of the Service complies with all applicable laws, including call recording notification and any industry-specific regulations.
- CONFIGURATION ACCURACY: You are responsible for providing accurate and up-to-date business information to configure your AI agent.
- CALENDAR MANAGEMENT: You are responsible for maintaining accurate availability in your connected calendar to ensure correct bookings.
- DELIVERY NOT GUARANTEED: SMS, email, and call delivery is dependent on third-party services and cannot be 100% guaranteed.
- NO WARRANTY: The Platform is provided “as is” without warranties of any kind, express or implied.
6. Service Availability
6.1 No Guarantee of Uptime
We strive for high availability but do not guarantee uninterrupted access. The Platform may be temporarily unavailable for maintenance, updates, or unforeseen issues.
6.2 No Liability for Downtime
We are not liable for missed calls, lost bookings, or business losses resulting from Platform unavailability.
7. Governing Law
This Disclaimer is governed by the laws of the jurisdiction in which Digital Automations AI operates. Disputes shall be resolved in accordance with our Terms of Service.
